By downloading, installing, or using FitnessPoker ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

FitnessPoker is a fitness gamification mobile application that combines card drawing mechanics with exercise activities. The App provides:

  • A card-based exercise assignment system
  • Multiplayer workout sessions for up to 4 players
  • Customizable exercise mappings
  • Timer and statistics tracking features

The App is provided "as is" for your personal, non-commercial use.

3. Medical Disclaimer and Assumption of Risk

FitnessPoker is not a substitute for professional medical advice, diagnosis, or treatment. Before beginning any exercise program:

  • Consult with a qualified healthcare provider
  • Ensure you are physically capable of performing the exercises
  • Stop immediately if you experience pain, dizziness, or discomfort

By using FitnessPoker, you acknowledge that:

  • Physical exercise carries inherent risks
  • You voluntarily assume all risks associated with using the App
  • You are solely responsible for your safety during exercise
  • You will exercise within your capabilities and limitations

4. User Responsibilities

When using FitnessPoker, you agree to:

  • Use the App only for lawful purposes
  • Exercise in a safe environment with adequate space
  • Supervise minors using the App under your care
  • Not modify, reverse engineer, or attempt to extract the source code
  • Not use the App for any commercial purposes without permission

5. Intellectual Property

All content, features, and functionality of FitnessPoker, including but not limited to:

  • App design and user interface
  • Graphics, logos, and icons
  • Software code and algorithms
  • Text and instructional content

Are owned by FitnessPoker and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without explicit permission.

6. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the App on your personal iOS device
  • Use the App for personal, non-commercial fitness activities

This license does not allow you to:

  • Share, sell, or distribute the App
  • Use the App for commercial fitness classes without permission
  • Modify or create derivative works

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF INFORMATION

We do not warrant that the App will be uninterrupted, error-free, or free from viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITNESSPOKER SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Personal injury or property damage resulting from App use
  • Loss of data, profits, or business opportunities
  • Any damages exceeding the amount you paid for the App (if any)

9. Indemnification

You agree to indemnify, defend, and hold harmless FitnessPoker, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any injury or damage caused during exercise activities

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including violation of these Terms. Upon termination, your right to use the App will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FitnessPoker operates, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
